By accessing this website, purchasing a course, creating an account, making a donation, submitting an inquiry, registering for an event, or using any of our services, you agree to these Terms. If you do not agree, please do not use this website or purchase our products or services.
1. About Our Work
The Yes, AND Foundation exists to provide educational resources, brain-based tools, community learning experiences, and practical support for regulation, resilience, reframing, and forward motion. Our offerings may include online courses, digital resources, private community spaces, workshops, speaking engagements, consulting services, events, newsletters, blog content, and donor-supported initiatives.
Our content is educational and informational in nature. It is designed to support learning, reflection, growth, and practical application. It is not intended to replace medical care, mental health treatment, therapy, legal advice, financial advice, or any other licensed professional service.
2. Eligibility
By using this website, you represent that you are at least 18 years old or are accessing the website with the consent and supervision of a parent or legal guardian.
If you purchase a course, register for an event, make a donation, or submit an inquiry on behalf of an organization, you represent that you have the authority to act on behalf of that organization.

Course access may be provided through Kajabi or another third-party learning platform. When you purchase or enroll in a course, you may be required to create a login and password. You are responsible for maintaining the confidentiality of your login information.
You agree not to share your course login, password, private links, downloads, videos, worksheets, community access, or other paid materials with anyone who has not purchased or been granted access.
Unless otherwise stated in writing, your purchase provides access for one individual user only.
5. Course Access
Course access terms may vary by offer. Some courses may provide lifetime access, limited-time access, cohort-based access, or access for a specific period of time. The specific access terms will be stated on the applicable sales page, checkout page, or course description.
“Lifetime access,” when offered, means access for as long as the course remains available through our platform. It does not guarantee that the course, platform, community, or specific content will remain available forever. We reserve the right to modify, update, replace, retire, or discontinue course content at any time.
6. Payments
Payments for courses, digital products, events, workshops, or services may be processed through Kajabi, Stripe, PayPal, or another third-party payment processor.
By making a purchase, you agree to provide accurate billing information and authorize the applicable payment processor to charge your selected payment method.
If a payment fails, access to the purchased product or service may be paused, restricted, or canceled until payment is successfully completed.
We are not responsible for payment processing errors, declined payments, platform outages, or issues caused by third-party payment providers.
7. Refunds and Cancellations
Refund policies may vary by product, course, event, workshop, or service. The refund policy for each offer will be stated on the applicable sales page, checkout page, agreement, or registration page.
Unless otherwise stated in writing, all digital product and course sales are final due to the immediate access provided to digital content.
For consulting, speaking engagements, workshops, or events, cancellation and refund terms may be outlined in a separate written agreement. If a separate agreement applies, that agreement will be controlled.
We reserve the right to consider refund requests on a case-by-case basis, but submitting a refund request does not guarantee approval.
8. Community Access and Participation
Some courses or programs may include access to a private online community, discussion space, coaching circle, or group learning environment.
By participating in any community space, you agree to:
- Treat others with kindness and respect
- Protect the privacy and confidentiality of other participants
- Stay on topic and participate in good faith
- Avoid harassment, hate speech, bullying, threats, or harmful conduct
- Avoid giving medical, legal, financial, therapeutic, or other licensed professional advice unless properly qualified and authorized to do so
- Avoid sharing another participant’s personal story, comments, screenshots, or identity outside the community without permission
We reserve the right to remove posts, comments, or participants from any community space at our discretion, especially if we believe someone’s conduct is harmful, disruptive, unsafe, or inconsistent with the purpose of the community.
Community spaces are designed for education, reflection, and connection. They are not therapy, crisis support, or a substitute for professional mental health care.
9. Donations
The Yes, AND Foundation may accept donations to support its mission, programs, educational resources, community initiatives, events, scholarships, and other charitable purposes.
If The Yes, AND Foundation is recognized by the Internal Revenue Service as a tax-exempt organization under Section 501(c)(3) of the Internal Revenue Code, donations may be tax-deductible to the extent allowed by law.
We do not provide tax, legal, or financial advice. Donors should consult their own tax advisor regarding the deductibility of any contribution.
Unless otherwise stated, donations are voluntary and non-refundable. We reserve the right to decline, return, or restrict the use of a donation when appropriate.
Any donation receipt, acknowledgment, or tax-related documentation will be provided in accordance with applicable laws and organizational policies.
10. Speaking Engagements, Workshops, Events, and Consulting Services
We may offer speaking engagements, keynote presentations, workshops, training, consulting services, professional development, event appearances, or other custom services.
Submitting an inquiry through the website does not create a client relationship, guarantee availability, or confirm booking. A speaking engagement, consulting service, workshop, or event is not confirmed until both parties have agreed to the scope, fee, schedule, and terms in writing.
Some services may require a separate agreement, proposal, invoice, deposit, travel arrangement, cancellation policy, or statement of work. If a separate agreement applies, that agreement will control these Terms for the specific service.
We reserve the right to decline any inquiry, project, event, or service request at our discretion.

Our content is provided for educational and informational purposes only.
Although our work may reference brain science, adult learning, growth mindset research, regulation, resilience, reframing, emotional awareness, caregiving, education, leadership, or personal growth, it is not intended to diagnose, treat, cure, or prevent any medical, psychological, behavioral, or mental health condition.
